Industrial law – enterprise bargaining, industrial advocacy

Our industrial practice is one of the most respected in Australia.

Numerous unions trust their industrial advice to us, including the Australian Nursing Federation, the Communication Workers Union, the Australian Services Union, the Finance Sector Union of Australia, the Flight Attendants Association, and the Australian Principals Federation.

Most recently, our flagship industrial law department advised the Victorian Branch of the Australian Nursing Federation in their successful industrial campaign for wage rises, the protection of nurse/patient ratios, and improved conditions against the Victorian Government.

The firm has acted in the full range of issues arising under the Fair Work Act, the Workplace Relations Act and its predecessor Acts, having a role in:

  • Union registration and rules cases
  • Award and Agreement making, approval and disputes
  • Matters involving right of entry
  • Notices of initiation of bargaining period and industrial action, and
  • Appeals on issues of jurisdiction and merit.

Our industrial team services a large union constituency involved in negotiating new enterprise agreements and disputes. This can lead to our involvement in campaigns that result in legal advice, action and in proceedings in various jurisdictions, including the High Court, the Federal Court, the Federal Circuit of the Australia (previously the Federal Magistrates Court), the Supreme Court and the Fair Work Commission.

We also assist unions and groups of employees with disputes regarding the application or possible breach of existing enterprise agreements.
